Terms of Use

These Terms of Use are an agreement between you and Vibby Labs Inc. ("we", "us") about your use of Havony. By creating an account or using Havony, you agree to these Terms, our Privacy Policy and our Community Guidelines. If you don’t agree, please don’t use Havony. Effective October 9, 2026.

1. Who can use Havony

• You must be at least 18 years old.
• You must be able to form a binding contract and not be barred from using the service under any applicable law.
• You must not have been convicted of, or pleaded no contest to, a felony or any crime involving violence or a sexual offense, and you must not be required to register as a sex offender.
• You may keep only one account, and it must represent you — a real person, not a business, group or someone else.

2. Your account

You sign in with your phone number. Keep access to it secure: you are responsible for activity on your account. Tell us right away at hello@havony.com if you think someone else has access.

Information you give us must be accurate and kept up to date, including your age.

3. Photo verification

To keep Havony real, we ask for a verification selfie and compare it with your profile photos using automated face matching. Photos you add or change later are compared with your selfie too. How this data is handled is explained in the Privacy Policy, and we only do it with your consent.

If a photo you add after sign-up doesn’t match your selfie, your account may be put on hold automatically. While it’s on hold you can’t use Havony except to replace that photo. Replacing it with a photo of you that matches lifts the hold. Photos that are probably you but not certain may be reviewed by a person instead.

Verification lowers the risk of fake profiles but cannot guarantee that anyone is who they say they are.

Photos are screened automatically when you upload them. Photos showing nudity, sexual content, graphic violence, self-harm, disturbing images or hate symbols are refused. Photos that might break our Community Guidelines — for example ones showing weapons — stay hidden from other members until a person reviews them, and may be removed.

4. Your content

You own the photos, text and other content you post ("your content"). You give Vibby Labs Inc. a worldwide, non-exclusive, royalty-free license to host, store, copy, display, adapt (for example resize or crop) and distribute your content only to operate, improve and promote Havony within the app. The license ends when you delete the content or your account, except for copies we must keep for legal, safety or backup reasons for a limited time.

You confirm you have the rights to everything you post, and that it follows these Terms and the Community Guidelines.

5. How you must not use Havony

• Harass, threaten, stalk, bully, intimidate or harm anyone, or post hateful or discriminatory content.
• Post nudity, sexually explicit material, violence, or anything involving a minor.
• Impersonate anyone, use someone else’s photos, or misrepresent your identity, age or intentions.
• Ask for money, promote businesses, run scams, spam, or advertise.
• Share other people’s private information without permission.
• Use bots, scrapers or automated means to access Havony, or try to get around verification, holds, blocks or security.
• Reverse engineer, copy or resell the service, or use it for anything illegal.

6. Safety

You are responsible for your interactions with other members, online and in person. Vibby Labs Inc. does not run criminal background checks and does not verify members’ statements. Meet in public places, tell a friend where you’re going, and never send money to someone you met on Havony. You can block or report anyone from their profile; we review reports and may remove content or accounts.

7. Premium, Gold Passes, Boosts, Super Likes and Notes

Purchases in the iPhone app are made through your Apple ID and processed by Apple under Apple’s Media Services Terms. Prices are shown in the app before you buy.

Havony Premium subscriptions renew automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the period ends. You can manage or cancel in your iPhone’s Settings › Apple ID › Subscriptions. Cancelling stops future renewals; you keep Premium until the paid period ends.

A Gold Pass gives Premium features until 7:00 AM your local time on the last day of the pass and does not renew.

Boosts, Super Likes and Notes are single-use features with no cash value. They are stored on your account and are not transferable.

Refunds are handled by Apple under its policies (reportaproblem.apple.com). If Apple refunds a purchase, we remove what it bought from your account, including unused Boosts, Super Likes or Notes.

Purchases are for use in Havony only. If we close your account for breaking these Terms, we are not required to refund unused purchases, except where the law requires it.

8. Ending your account

You can delete your account at any time in Settings › Manage my account › Delete my account. Deleting your account does not cancel an Apple subscription; cancel that in your Apple ID settings.

We may suspend, put on hold or close accounts that break these Terms or the Community Guidelines, put others at risk, or where the law requires it. Where appropriate we will tell you why.

9. Changes

We may update Havony and these Terms. If a change is material we will tell you in the app or by email before it takes effect. Using Havony after the change means you accept the updated Terms.

10. Disclaimers

Havony is provided "as is" and "as available". To the fullest extent the law allows, Vibby Labs Inc. disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that Havony will be uninterrupted, error-free, or that you will find a match.

11. Limitation of liability

To the fullest extent the law allows, Vibby Labs Inc. will not be liable for indirect, incidental, special, consequential or punitive damages, or for the conduct of any member, on or off Havony. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some places don’t allow these limits, so they may not apply to you.

12. Disputes and governing law

These Terms are governed by the laws of the United States that apply, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at hello@havony.com so we can try to resolve it informally. Nothing in these Terms limits rights you have as a consumer under the laws where you live.

13. Apple

• These Terms are between you and Vibby Labs Inc., not Apple. Apple is not responsible for Havony or its content.
• Apple has no obligation to provide maintenance or support for Havony.
• If Havony fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); Apple has no other warranty obligation.
• Apple is not responsible for any claims relating to Havony, including product liability, legal or regulatory compliance, consumer protection, privacy, or intellectual property claims.
• You confirm you are not in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Trademarks

Havony™ is a trademark of Vibby Labs Inc. A U.S. trademark application for the name Havony is pending. You may not use the Havony name without our written permission.
